Privacy Policy: Shunya Bots

1. Who we are. This website is run by Trust Gem (Shunya Bots) ("we", "us"), a sole proprietorship based in Pune, India. We build AI automations, AI chatbots, and AI design and video for small businesses. Contact: shunyabots@zohomail.in.

2. What we collect.

3. Why we use it, and our legal basis. We use your data to reply to you, assess your project and prepare a written plan from your intake form, write proposals, deliver and support projects, send invoices, keep the site secure, and meet legal, tax and foreign-exchange record-keeping duties. Under India's DPDP Act 2023, we rely on your consent (which you give when you submit a form) and on legitimate uses such as data you give us voluntarily for a service and compliance with law. Under the EU/UK GDPR, our legal bases are steps before a contract and performing it, our legitimate interests (replying to enquiries, security, improving our service), legal obligation, and consent where we ask for it. We do not send marketing emails unless you opt in, and we never sell or "share" personal data for cross-context advertising.

4. AI processing. To deliver AI services we may send client data, through their business APIs, to the AI model providers used for your project (such as OpenAI, Anthropic, Google or Groq), named in your Order Form. We use provider API settings that, under their current terms, do not use your data for model training. We do not use client data to train our own models.

5. Who we share it with. We share data only with service providers that help us run the business (hosting by Cloudflare, forms by Zoho, email, AI APIs, Wise and Upwork), with professional advisers, and with authorities where the law requires. Each provider gets only what it needs to do its job.

6. International transfers. We are based in India, and the data you submit through our forms is stored in India (Zoho's India data centre). Some other providers, such as our website host (Cloudflare, Inc., USA, which serves the site from its global network of data centres), AI APIs, Wise and Upwork, may process data in other countries, including the United States. Indian law allows transfers except to countries the Government restricts. For EU/UK data we rely on adequacy decisions, including the EU-U.S. Data Privacy Framework and its UK Extension for providers certified under it (such as Cloudflare), or on the providers' Standard Contractual Clauses (or the UK Addendum).

7. How long we keep it. Enquiries that don't lead to a project: up to 12 months. Intake form data from people who don't become clients: deleted within 12 months. For clients, intake data is treated as project data (below), except details we need for client and invoice records. Client and invoice records: 8 years, for tax and foreign-exchange (FEMA) purposes. Project data: deleted or returned within 30 days of a project ending unless the contract says otherwise. Server logs: as set by our host.

8. Security. We use reasonable security practices (IT Act 2000 s.43A and the 2011 SPDI Rules), including access controls, two-factor authentication, keys held in secret stores, and least-privilege access. If a data breach affects you, we will tell you and the relevant regulators as the law requires. In India that means telling the Data Protection Board without delay, with a detailed report within 72 hours, once those rules apply.

9. Your rights. You can ask to access, correct, update or delete your data, withdraw consent (as easily as you gave it), and nominate someone to act for you (India). EU/UK residents can also object, restrict processing, and ask for portability. California and other US-state residents can ask to know about, delete or correct their data, and will not be treated differently for asking. Email shunyabots@zohomail.in. We reply within 30 days, and Indian grievances are resolved within 90 days at most. You may also complain to the Data Protection Board of India, your EU supervisory authority, or the UK ICO.

10. Children. The site and our services are for businesses. We don't knowingly collect data from anyone under 18. If you think we have, email us and we will delete it.

11. Cookies. We use only cookies that are strictly needed for the site to work. We do not use analytics or advertising cookies. Embedded tools, such as the Zoho form, may set their own cookies under their own policies.

13. Changes. We may update this policy. The effective date above shows the latest version, and we will flag significant changes on the site.
